There are many laws governing surveillance. When and where is it legal to record audio? Video or still photographs? What restrictions must be followed for any evidence to be admissible in court? After nearly 28 years in this profession, one question that has been asked over and over is, “Are you a private investigator or a private detective?” My answer only causes them further confusion, as the answer is based on the type of case I’m working and the client I am working for.

Simply put, investigators conduct civil investigations and detectives conduct criminal investigations. To clarify, if the evidence I collect is for a criminal case and will ultimately be presented to a criminal court, then I am in the Detective mode. I may be hired by a municipality, a private individual or their attorney in order to gather information for a criminal issue. This could be for either the prosecution of a person or persons or to the defense of a person to whom criminal charges have been levied.

Similarly, if the evidence I collect is for a civil case and will ultimately be presented in the civil court, then I am in the Investigator mode. Quite often an insurance company or its attorney will hire to assist in the defense of a claim. Matrimonial and child custody investigations (also known as domestic cases) are also examples of Investigator cases. Rarely will a case end up in both court systems, but it is not unheard of. For that reason, those working for the District Attorney’s Office are often referred to as Detective Investigators.

We at Special Enforcement Bureau are well versed in both criminal and civil private investigations, having been trained by a cadre of New York City Police Detectives, SIU Specialists and years of honing skills to meet the needs of our clients. Do not waste your valuable and limited reserve resources using national companies that utilize under-trained, over-used, inexperienced trainees to complete what seasoned professionals should be doing. If they cannot answer the above question, should you be trusting them with your assignments?
